However the problem with case insensitivity is that unicode is an evolving standard such that two operating systems can legitimately disagree about file name overlaps. With case sensitive file systems the question of consistency goes away since all filenames are consistently allowed. However as soon as you introduce case insensitivity the case rules for every alphabet supported by unicode needs to be checked for filename collisions
